1. Acceptance of Terms

Welcome to ATSNinja. These Terms of Service ("Terms") govern your access to and use of the ATSNinja website, services, and applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Service Description

ATSNinja is a SaaS platform that provides AI-powered resume analysis services, including:

  • Free ATS Score: Basic Applicant Tracking System (ATS) compatibility score for uploaded resumes
  • Paid Full Analysis: Comprehensive resume analysis with detailed recommendations, keyword suggestions, and formatting guidance ($4.99 one-time payment per scan)
  • Job Description Matching: Tailored analysis when a job description is provided
  • Dashboard: Access to your scan history and analysis results

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. Account Registration and Security

Account Creation: You may create an account using email/password or Google OAuth. You must provide accurate and complete information.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. You must immediately notify us of any unauthorized use.

Age Requirement: You must be at least 16 years old to use our Service.

4. User Conduct and Prohibited Activities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Upload resumes that you do not own or have permission to analyze
  • Upload files containing malware, viruses, or other harmful code
  • Attempt to circumvent, disable, or interfere with security-related features
  • Use automated tools, bots, or scripts to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, redistribute, or sublicense the Service without authorization
  • Upload illegal, fraudulent, defamatory, or offensive content
  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Abuse the Service through excessive uploads or resource consumption

Violation of these rules may result in immediate termination of your account and legal action.

5. Payment Terms

5.1 Pricing

Full resume analysis costs $4.99 USD per scan (one-time payment). Prices are subject to change with 30 days notice. The free ATS score will always remain free.

5.2 Payment Processing

Payments are processed securely through Stripe, Inc. We do not store your credit card information. By making a payment, you agree to Stripe's terms and conditions.

5.3 No Subscriptions

All payments are one-time charges. There are NO recurring subscriptions or automatic renewals. Each resume analysis is a separate transaction.

5.4 Refund Policy

Refunds are issued at our sole discretion and must be requested within 24 hours of purchase. Refunds are provided in the following circumstances:

  • Technical issues prevented you from accessing your analysis
  • The analysis contained significant errors or failed to complete
  • You were charged incorrectly or multiple times

Refunds are NOT provided for dissatisfaction with analysis results, as our Service provides guidance based on general ATS best practices and cannot guarantee specific outcomes.

6. Intellectual Property Rights

6.1 Our IP

The Service, including its code, design, text, graphics, logos, and AI algorithms, is owned by ATSNinja and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service.

6.2 Your Content

You retain ownership of resumes and job descriptions you upload ("Your Content"). By uploading Your Content, you grant us a limited license to process, analyze, and store it solely to provide the Service. This license terminates when Your Content is deleted (automatically after 24 hours for resume files).

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without compensation or obligation to you.

7. Disclaimers and Limitations of Liability

7.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

7.2 No Guarantees

We do NOT guarantee that:

  • Use of our Service will result in job interviews, job offers, or employment
  • Your resume will pass any specific ATS system
  • Our analysis will be error-free, complete, or applicable to your situation
  • The Service will be uninterrupted, secure, or virus-free

7.3 ATS Variance

ATS systems vary widely across companies and industries. Our analysis represents general best practices and may not reflect every ATS system's specific requirements. Results should be used as guidance, not absolute requirements.

7.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATSNinja SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR $100 IF YOU PAID NOTHING).

8. Indemnification

You agree to indemnify, defend, and hold harmless ATSNinja, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) Your Content.

9. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. Key points:

  • Resume files are automatically deleted 24 hours after upload
  • Data is stored on servers in Germany (EU)
  • We comply with GDPR, CCPA, and other privacy laws
  • Payment information is handled by Stripe and never stored on our servers

10. Termination

By You: You may stop using the Service and delete your account at any time through account settings.

By Us: We may suspend or terminate your access immediately, without notice, for any reason, including violation of these Terms, fraudulent activity, or abuse of the Service.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. Sections that should survive termination (including payment obligations, disclaimers, limitations of liability, and dispute resolution) will remain in effect.

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of courts located in San Francisco County, California.

11.2 Informal Resolution

Before filing a claim, you agree to contact us at contact@atsninja.app to attempt to resolve the dispute informally. We will attempt to resolve within 30 days.

11.3 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except for claims under $10,000 which may be resolved in small claims court.

11.4 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions, class arbitrations, or representative actions.

12. DMCA Copyright Policy

We respect intellectual property rights. If you believe content on our Service infringes your copyright, contact us at: contact@atsninja.app

Include: (1) description of copyrighted work; (2) location of infringing material; (3) your contact information; (4) statement of good faith belief; (5) statement under penalty of perjury; (6) physical or electronic signature.

13. Modifications to Terms

We may modify these Terms at any time. Material changes will be notified by email or prominent notice on the Service at least 30 days before taking effect. Continued use after changes constitutes acceptance. If you do not agree to modified Terms, you must stop using the Service.

14. General Provisions

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and ATSNinja
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect
  • No Waiver: Failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms; we may assign them to any successor
  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our control
  • Export Control: You agree to comply with all export laws and restrictions
